What is Title 9?

  • Title IX refers to federal anti-discrimination laws that ensure sex-based equality in education.

  • Students and employees may not be excluded from participation in, be denied the benefits of or be subjected to harassment or other forms of discrimination on the basis of sex in any program or activity.

  • Schools must offer female and male students equal opportunities to play sports.

  • Equipment, supplies, schedules and budgets offered to teams are to be equivalent between male and female sports.

  • Pregnant and parenting students have the same right as any other student to continue in their regular school and in any program for which they qualify.

No harassment

  • Sexual harassment is a form of discrimination and is therefore prohibited.

  • Schools must respond to allegations of sexual harassment once they are reported.

  • Title IX sexual harassment is conduct on the basis of sex that satisfies one or more of the following: (1) An employee conditioning the provision of an aid, benefit, or service of the District on an individual’s participation in unwelcome sexual conduct; (2) unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to the District’s education program or activity; (3) sexual assault, dating violence, domestic violence, and stalking.

Other forms of behavior may be inappropriate, but not meet Title IX criteria above. In these cases, the inappropriate behavior would be addressed through other District policies, such as the Code of Student Conduct.

You can help

  • You have the right to a harassment free education. If you or someone you know has been the victim of sexual harassment, please report the incident immediately to a school site administrator or trusted adult.

  • Do not harass. “I was only kidding” is not a defense for sexual harassment and other inappropriate behavior.

  • Do not encourage harassment or stand by while someone else is being harassed. Having an audience could encourage the harasser to continue.

  • Be respectful and kind to everyone. Consider how your words may be perceived by others before you speak.

  • If you are harassed, tell the harasser to stop.

  • If the harassment continues, report it to an adult in the school building.

If friends or classmates confide in you that they have been sexually harassed, encourage them to report and consider reporting it to an trusted adult yourself.
